Privacy policy

Lush Lychees respects your privacy. This policy explains what we collect, why, who we share it with and how you can access or correct it. We handle personal information in accordance with the Australian Privacy Principles in the Privacy Act 1988 (Cth).
We do not sell your personal information, and we do not rent or trade our customer list.
1. WHO WE ARE

2. WHAT WE COLLECT

Contact and delivery details: your name, email, phone number, delivery and billing address.

Order information: what you bought and when, your order history, gift messages and delivery instructions.

Payment information: payment confirmations and the card type and last few digits. We never see or store your full card number.

Bookings and enquiries: farm tour and event bookings, and wholesale enquiries.

Website information: your IP address, device and browser type, the pages you visit and information collected through cookies.

Correspondence: emails and messages between us, including photos you send to support a return.
We only collect sensitive information where you volunteer it, such as a dietary requirement for a farm tour, and we use it only for that purpose.
3. HOW WE COLLECT IT
Directly from you when you order, subscribe, book or email us. Automatically through our website, Shopify and cookies. From our carriers when they update us about a delivery.
If you give us someone else's details, for example when you send a gift, please make sure they are happy for you to do that.
4. WHY WE COLLECT IT
To process, dispatch and deliver your order and take payment. To handle returns, refunds and freshness claims. To answer your questions and manage bookings. To send you our newsletter, if you have asked for it. To run and improve our website. To meet our legal, tax, food safety and liquor licensing obligations.
5. WHO WE SHARE IT WITH

Shopify, which hosts our online store.

Payment providers, including Shopify Payments and PayPal.

Delivery carriers, including Team Global Express and Australia Post.

Our email marketing platform, and analytics or advertising platforms where these are enabled on our site.

Our accountant and lawyer, where they need it, and government agencies where the law requires it.
Our Lychee Liqueur and Lychee Vodka are sold by Reef Distillers, not by us. If you follow a link to buy them, you leave our website and their privacy policy applies to whatever you give them. We do not pass your details to Reef Distillers and we do not receive their customer information.
6. OVERSEAS DISCLOSURE
Some of these providers store data outside Australia. Shopify is based in Canada and stores data in Canada, the United States and elsewhere. Our payment, email and analytics providers may process data in the United States and the European Union. Where we disclose personal information overseas, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles.
7. MARKETING
If you subscribe, we will send you news about the season, new products, recipes and Farm Gate hours. We do not send marketing to people who have not asked for it.
Every marketing email has an unsubscribe link and it works. You can also email us to be taken off the list. Unsubscribing does not stop order confirmations, dispatch notices and tracking emails.
8. COOKIES
Our website uses cookies to keep your cart working, remember you between visits, understand how the site is used and, where enabled, show you our advertising elsewhere. You can block or delete cookies in your browser settings, though the cart and checkout may not work properly if you do.
9. SECURITY AND HOW LONG WE KEEP IT
We take reasonable steps to protect personal information from misuse, loss and unauthorised access. Our store runs on Shopify over an encrypted connection and payments are handled by specialist providers. No system is completely secure. If a breach happens that is likely to cause serious harm, we will notify affected people and the Office of the Australian Information Commissioner.
We keep order and payment records for at least 7 years, as tax law requires. Marketing subscriptions are kept until you unsubscribe. When we no longer need information and are not required to keep it, we destroy or de identify it.
10. ACCESS, CORRECTION AND DELETION
You can ask us for a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it. Email hello@lushlychees.com.au and we will respond within 30 days. There is no charge. If you have an account you can also update your own details by logging in.
We may need to keep some records to meet legal obligations. In limited circumstances the law allows us to refuse a request, and if that happens we will tell you why in writing.
11. CHILDREN
Our website and products are not intended for people under 18 and we do not knowingly collect personal information from children.
12. COMPLAINTS
Email hello@lushlychees.com.au with the details. We will acknowledge your complaint within 7 business days and respond within 30 days.

13. CHANGES
